Notice to Bidders

The information included herein is a summary of information available from a number of sources, most of which have not been indepedently verified. The sources from which the infor mation was gathered are believed to be reliable; however, all information contained within this package is subject to verification by all parties relying upon such information. NO representations or warranties, expressed or implied, as to the accuracy or completeness of such information in this and any other advertising materials shall be deemed made, and no legal obligation shall arise by reason of this package or it's contents.

The summary has been provided only for the use of the prospective bidders. Buyers must rely on his/her own information, inspections, review of public records and own determination to bid, consulting whatever advisors he/she may deem appropriate.

The property or properties described is being sold “AS-IS, where is, with all faults” condition. Neither the Seller, Broker, nor any other respective agent related to this sale make any express or implied warranties of any kind.


General Information/Terms and Conditions

Please be prompt as it only takes minutes to sell a property. We will start on time. There will be an explanation of the terms and conditions before each property is sold. When, at the sole descretion of the acutioneer, the auction is opened for bid, all absolute properties will be sold to the highest bidder. Any properties sold Absolute will be announced as such.

Terms and Conditions of the Sale:

Lindel M. Swiney is acting as agent of the seller. The auctioneer's decision is final in the event of a dispute over any matter. The Auctioneer reserves the right: 1) to revoke the bidding priveliges of any bidder at any time; 2) refuse any bid which is merely a fractional increment over the preceding bid; 3) sell by choice, group, add to, withdraw from, or change the selling order of any property; 4) reopen the bidding in the event of a tie; 5) not accept a highest bid as the successful bid due to a seller's reserve not being met or for any other reason; and 6) waive any and all previously announced requirements related to the sale.

All announcements from the auction block superced and printed materail or any other statements made previosly. The property is being sold “AS-IS, where is” condition subject to “all faults”. You are urged throughly to inpsect the property before the auction. The purchaser/buyer must relay on his/her own information, inspection, record and determination.

Concerning Terms:

• A 10% BUYERS PREMIUM will be added to the last highest final bid and will be included in the Full Contract Price.
• Bidders must execute a Contract for Sale and Purchase of Real Estate and Deposit of 10% of the full amount of the contract price day of sale.
• Buyers should have all inpsections (including lead based paint) completed prior to the date of auction.
• Seller will provide Warranty Deed and Title Insurance.
• Buyer will be responsible for documentary stamps, and recording of deed, and any other additional taxes or fees.
• Prorations will be day of closing.

How to Bid:

Although there is no obligation to bid, all prospective bidders must register in order to bid at the auction. Registration will open at the auction site 30 minutes prior to the sale.

After the Auction, if you are the high bidder, you will be required to sign a Contract for Sale and Purchase of Real Estate and post a deposit as required.

Broker Partisipation:

Broker encourages Cooperating Brokerage partisipation with licensed real estate brokers.

• A commission of two percent (2%) of the high bid will be paid at closing to a cooperating broker who resgisters the successful buyer who closed on the proerty. (No commission will be paid if the prospective buyer fails to close on the proerty).
• Broker must register his/her client prior to the starting of the auction.
• Registraton must be signed by broker and client.
• The cooperating broker must attend the auction with his/her client.
• Brokers acting as principals are not eligible for this comission.
• Any respective agents are acting on behalf of the seller
